Surrogacy is an alternative assisted reproductive technique that allows individuals who would otherwise be unable to have children due to infertility or other medical issues to start families through the services of a surrogate mother. This arrangement enables a woman (the surrogate) to carry and birth a baby on behalf of another person or couple.
Legal Recognition and Framework of Surrogacy in Ghana
Yes, surrogacy is legal in Ghana. Section 22 of the Registration of Births and Deaths Act, 2020 (Act 1027) has established a comprehensive legal framework for surrogacy arrangements in the country. This legislation clearly states that an intended parent may engage the services of a person to act as a surrogate for the purpose of providing the intended parent with a child through surrogacy, thus formalising the legal foundation for these arrangements.
Who Can Act as a Surrogate in Ghana
According to the legislation, surrogacy is defined as an arrangement where an embryo, formed from the egg and sperm of individuals other than the surrogate and her partner, is implanted into the surrogate mother. This definition establishes the parameters for legitimate surrogacy arrangements under Ghanaian law.
Types of Surrogacy Recognised
The Ghanaian legal framework supports both gestational surrogacy, where the surrogate has no genetic link to the child, and traditional surrogacy, where the surrogate’s egg is used. This flexibility allows intended parents to choose the arrangement that best suits their circumstances and preferences.
Surrogacy Costs and Compensation
The costs of surrogacy in Ghana are relatively lower than in Western countries, adding to its appeal as a destination for international intended parents. Depending on the service and program selected, interested parties may pay within the range of USD 25,000 to USD 58,400, which typically covers surrogate compensation, in vitro fertilisation (IVF) treatments, and associated medical care.
Surrogate mothers in Ghana can receive compensation between GHS 50,000 and GHS 120,000, reflecting the country’s commitment to ensuring fair compensation for surrogates while maintaining affordable options for intended parents.
